A small beach hut, a really cosy jungle retreat with a view of the sea or a villa in the middle of seemingly endless rice fields. No matter whether it is to serve as a retirement provision or a holiday home in the middle of Bali's paradise, many people dream of owning their own Bali property.
The island of Bali is one of about 17,000 islands that belong to Indonesia. But is it at all possible to buy a property on Bali as a foreigner in Indonesia? And if so, what do I have to consider?

Can foreigners buy property in Bali?
Basically, it is not possible for foreigners to buy land or property in Bali. This is prohibited by Indonesian law. Nevertheless, there are countless foreign citizens who have owned and lived in real estate on the dream island for a long time.
This is made possible by various regulations, which, however, do not always comply 100% with the law. We would like to introduce two regulations that are legal and in accordance with the law.
- The right of use (Hak Pakai)
Under this arrangement, the foreign citizen receives a certificate that is issued in his or her name. This is registered with the relevant authorities. It grants the foreigner the right to the exclusive use of the land, or real estate, of Bali. This right is guaranteed by the laws of Indonesia. This certificate is valid for a maximum period of 80 years, including all renewal options. However, it is important to note that the size of the land may only be between 1500 and a maximum of 2000 m² in order to be able to claim this right of use. - Leasehold (Hak Sewa)
This is a kind of rental or leasing contract between the Indonesian owner of a property on Bali and a foreigner. Although this lease is notarised, the document is not recognised by official authorities, unlike the hak pakai mentioned above. Leasing contracts are often concluded for a period between 25 and 30 years. Long-term leases, on the other hand, are for about 2 to 5 years. Especially in Bali real estate, the trend is now more and more clearly towards concluding long-term leases.
What else is there to consider when buying property in Bali?
One possibility for a foreigner to buy property in Bali that is often offered, especially on the internet, are so-called nominee contracts. You should definitely keep your hands off these, because they are not legal and can deprive you of your savings and shatter your dream of owning a house in Bali.
With nominee contracts, non-Indonesian property buyers purchase land or property under the name of an Indonesian citizen. This and other documents are supposed to guarantee the foreigner all rights to the property. However, this is not the case. The reason for this is that Indonesia's agricultural law strictly prohibits this. Any dealings of foreign citizens with real estate, such as buying, selling or exchanging, are strictly forbidden.If problems arise and the nominee contract concluded is discovered, it is immediately declared null and void by the law and the property in Bali goes to the hands of the state. You would then have lost both your money and your dream house.

In principle, it is possible to fulfil your dream of owning a property in Bali. However, it is associated with some stumbling blocks, which is why you should definitely seek extensive advice.
